How Lemon Law Applies to Used Cars in California

California lemon law helps protect consumers who purchase vehicles. Many think these laws can only apply to brand-new cars, but that isn't the case! Used and Certified Pre-Owned Vehicles may also be protected under this law, but like new cars, they must meet specific criteria to qualify.

Here, we cover how the lemon law might apply to used cars in California.

Qualifying for Lemon Law Protection

The Golden State is one of the best places to purchase a used car. Why? California has some of the nation's most comprehensive lemon law statutes, offering robust protection for qualifying purchases of:

  • New & used vehicles
  • Motorcycles
  • RVs
  • Boats
  • Small planes

How can you qualify for California's lemon law regarding used cars? The vehicle must have been sold with an express written warranty. While the warranty itself could be provided by a dealership, manufacturer, or other entity responsible for offering assurances to purchasers, a warranty is a must-have requirement.

Another requirement for qualifying for protection under California's lemon law is the presence of a defect. Furthermore, the defect must arise during the warranty period and can't be adequately repaired after a reasonable number of attempts. If those requirements are met, the used car may qualify as a lemon and, thus, for protection under the lemon law.

"Reasonable Number of Attempts"

How many attempts is a "reasonable number?" A reasonable number can vary on a case by case basis, but could be:

  • The same defect or problem persists after two or more attempts to repair it
  • The used car has been in the shop for repair attempts for a cumulative total of 30 or more days

What You May Be Entitled To

If you've:

  • Purchased a warranty-covering used car
  • Dealt with a persistent defect or problem through no fault of your own, like how you've operated the vehicle
  • Gone to the dealer or manufacturer, and they've made a reasonable number of attempts to repair the defect but have been unsuccessful

You may be entitled to a refund of the purchase price of the used car, a replacement vehicle, or monetary compensation for any incurred damages. The exact outcome of your case depends on several factors, including the lemon law attorney you choose.

Lemon Law Limitations

It's important to note that there is a used car lemon law timeframe; protection does not extend indefinitely. Typically, protection under this California law lasts for the used car’s warranty period.

That makes it imperative to speak with a lemon law lawyer when you suspect you've purchased a faulty used vehicle.
